CYCLESOUTH TERMS OF SERVICE
If you use the CycleSouth website (“Website”), you are responsible for maintaining the privacy of your account and access to your account. You are responsible for all communications and activity within your account, which is protected by your password. Your use of the CycleSouth Website is at your sole and absolute risk.
Communications between you and CycleSouth will occur electronically through the Website (including notifications or updates from CycleSouth) and through emails. For legal purposes, CycleSouth electronic communications are accepted as written communications.
Personal information provided to CycleSouth through account set-up, class purchases, class reservations and retail purchases is voluntarily provided by you. This information will be used to contact you with confirmations, notices, updates, marketing promotions and other important information.
ACCEPTANCE OF TERMS
By using the CycleSouth Website, you signify your acceptance to the Terms of Service. Future revisions or additions to the Terms of Service may occur from time to time. Continued use of the Website signifies acceptance to the revised Terms of Service. You are encouraged to visit the Website and review the Terms of Service periodically.
It is strictly forbidden for you, or anyone you provide access to the Website to reverse engineer, reproduce or transmit any information or content of CycleSouth’s Website without the express written consent of CycleSouth.
CycleSouth will make reasonable efforts to ensure the security of transactions made on the Website. All reasonable efforts will be made to secure client information; however, no system can prevent all security breaches.
CycleSouth reserves the right to withdraw or amend the content on the Website at any time in its sole discretion. CycleSouth will not be liable if any portion of the Website is unavailable from time to time. Management may restrict access to certain areas of the Website from time to time for maintenance or other purposes. CycleSouth reserves the right to refuse service, delete, edit content or delete accounts and orders, at its sole discretion.
RESERVATIONS, CHARGES AND CANCELLATIONS
In order to reserve a bike in a class, you must first create an account and purchase a class or class package. If you already have an account, you can log in, use existing classes in your account or purchase a class or class package and make your reservation.
CycleSouth accepts Visa, MasterCard and American Express. Credit cards are charged when you submit your reservation. Reservations can be made for up to one week in advance (Sunday through following Sunday). Online reservations must be made at least one hour before class begins. In person reservations at the studio may be processed 15 minutes prior to the class if bikes are available.
Class cancellations must be made at least 12 hours prior to your assigned class. If you cancel more than 12 hours before your reserved class, your class will be returned to your account for future use. If cancelled less than 12 hours before your reserved class, you will be charged for the class even if you do not attend the class. Classes can be cancelled by logging into your account and hitting “UNRESERVE” or by calling the studio and speaking to a member of our staff.
FIVE MINUTE RELEASE: reserved bikes will be released and available to other riders 5 minutes before class begins, so please ensure you arrive early for your class.
LATE ARRIVAL: riders arriving late can call the front desk to hold their bike for up to 10 minutes after class begins. If the rider arrives later than 10 minutes, the rider will not be permitted to enter the class as it is very disruptive to other riders. Rider will be charged for the class.
EARLY DEPARTURE: riders are asked to notify the instructor at the beginning of class if he or she needs to leave early. We kindly request that you exit quietly and not conduct post-class stretching in the class room as this disturbs other riders.
Unless otherwise stated in class purchase description, class packages do not expire. All class packages are non-refundable and non-transferable. Expiration policy and prices for future class packages are subject to change.
CLASS PARTICIPATION, ASSUMPTION OF RISK, WAIVER AND RELEASE
You acknowledge and agree that you are voluntarily participating in an indoor cycling class, using indoor cycling equipment, using CycleSouth facilities and/or participating in other activities and/or events at CycleSouth. You acknowledge such participation requires physical exercise, exertion and risk of physical injury or death. You attest that you are in good physical condition and do not suffer from any disability or impairment that would prevent or limit your participation in the class. You further agree to follow all written or verbal instructions provided by CycleSouth staff. You further agree and acknowledge that you accept and assume all risks of injury for participation in the class and all related events or activities at a CycleSouth studio. You further agree to immediately cease all participation in the class or any other activity in the event you sustain an injury.
You, for yourself and on behalf of your successors and assigns, waive and release CycleSouth and its agents from any and all claims, attorney fees, liabilities, damages, losses, expenses and obligations of every type or character, known or unknown, absolute or contingent, direct or consequential, whether arising at law or in equity, pursuant to contract, tort, statute or otherwise, which you now have or may have in the future arising out of or in any manner connected with the your participation in the class at any time.
LIMITATION OF LIABILITY
CycleSouth is not liable for direct, indirect or other damages related to your use of the Website, including without limitation, any.
CycleSouth assumes no responsibility for errors, typographical or otherwise, exclusions or inaccurate or omitted information in its Website or any third party linked sites. We expressly disclaim responsibility for any injury, liability, loss or damage, whether actual, consequential, personal or otherwise which is incurred or allegedly incurred as a direct or indirect consequence of the use of any of the contents of the Website.
